Furthermore, if your data is required for the fulfilment of a legal obligation, we will process it on the basis of Article 6(1)(c) GDPR. In addition, data processing may also be carried out on the basis of our legitimate interest in accordance with Article 6(1)(f) GDPR. The following paragraphs of this privacy policy contain information about the relevant legal bases in each individual case.

Information regarding data transfer to the USA and other third countries

We use, among other things, tools from companies based in the USA or other third countries that are considered insecure from the perspective of data protection. When these tools are active, your personal data can be transferred to these third countries and processed there. Please be aware that it is not possible to guarantee a comparable level of data protection in these countries as in the EU. For example, US companies are obliged to disclose personal data to security authorities without you, as the data subject, being able to take legal action against this. It therefore cannot be ruled out that US authorities (e.g. secret services) may be able to process, evaluate and permanently store your sensitive data on US servers for monitoring purposes. We have no influence over these processing activities.

Withdrawal of your consent to data processing

Many data processing procedures can only take place with your express consent. You can withdraw your consent at any time. This does not affect the legality of any data processing carried out prior to the withdrawal of your consent.

Right to object to data collection in special cases and to processing for direct marketing (art. 21 GDPR)

IF DATA PROCESSING IS CONDUCTED ON THE BASIS OF ARTICLE 6(1)(E) OR (F) GDPR, YOU SHALL HAVE THE RIGHT TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, AT ANY TIME TO PROCESSING OF PERSONAL DATA CONCERNING YOU, INCLUDING PROFILING BASED ON THOSE PROVISIONS. YOU WILL FIND THE RELEVANT LEGAL BASIS FOR A SPECIFIC TYPE OF PROCESSING IN THIS DATA PRIVACY STATEMENT. IF YOU OBJECT, WE SHALL NO LONGER PROCESS THE PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS OR FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ARTICLE 21(1) GDPR).

WHERE YOUR PERSONAL DATA ARE PROCESSED FOR DIRECT MARKETING PURPOSES, YOU SHALL HAVE THE RIGHT TO OBJECT AT ANY TIME TO PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING, WHICH INCLUDES PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA SHALL NO LONGER BE PROCESSED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ARTICLE 21(2) GDPR).

Right to lodge a complaint with the relevant supervisory authority

In the event of violations of the GDPR, the data subject has the right of appeal to a supervisory authority, in particular the supervisory authority in the member state of his/her typical residence, place of work, or the place of the alleged violation. The right of appeal exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to demand that we hand over to you or to a third party, in a commonly used, electronic format, any information which we have processed automatically on the basis of your consent or in the fulfilment of a contract. If you request a direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, erasure and rectification

Within the framework of the applicable legal provisions, you have the right to obtain information about your saved personal data, its origin and recipients, the purpose of data processing and, if necessary, the right to rectify or erase this data free of charge at any time. You can contact us at any time regarding this or if you have any further questions about personal data.

Right to restriction of processing

You have the right to request that the processing of your personal data is restricted. You can contact us regarding this at any time. The right to restriction of processing exists in the following cases:

  • If you contest the accuracy of the personal data we have on file, we usually need time to check this. For the duration of the checks, you have the right to request that the processing of your personal data is restricted.
  • If the processing of your personal data happened/is happening illegally, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to establish, exercise or defend legal claims, you have the right to request that the processing of your personal data is restricted instead of being erased.
  • If you have lodged a complaint pursuant to Article 21(1) GDPR, your interests must be weighed up against our own. Until it has been established whose interests outweigh the other’s, you have the right to request that the processing of your personal data is restricted.

If you have restricted the processing of your personal data, such data will, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

SSL or TLS encryption

For security reasons and for the protection of confidential content during transmission, such as orders or enquiries which you send to us as the website operator, this website uses SSL or TLS encryption. You can tell that a connection is encrypted if the browser address bar changes from “http://” to “https://” and also contains a padlock symbol.

When SSL/TSL encryption is activated, the data that you transmit to us cannot be read by third parties.

3. Data collection on this website

Cookies

Our website uses “cookies”. Cookies are small text files and will not harm your computer. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your end device until you delete them yourself or your web browser automatically deletes them.

In some cases, cookies from third-party companies can also be saved on your end device when you access our website (third-party cookies). These allow us or you to use certain services of the third-party company (e.g. cookies to process payment services).

Cookies have different functions. Many cookies are technically required, as certain website functions would not work without them (e.g. the shopping cart function or displaying videos). Other cookies are used to analyse user behaviour or to display advertising.

Cookies that are required to carry out the electronic communication process, to provide certain functions that you want (e.g. for the shopping cart function) or to optimise the website (e.g. cookies to measure the online audience) are saved on the basis of Article 6(1)(f) GDPR (necessary cookies), unless another legal basis is provided. The website operator has a legitimate interest in storing necessary cookies to ensure the optimised provision of its services without any technical errors. If consent to the storage of cookies or comparable recognition technologies has been requested, data is processed exclusively on the basis of this consent (Article 6(1)(a) GDPR and Section 25(1) TTDSG); this consent can be withdrawn at any time.

You can change your browser settings so that you are always informed about the storing of cookies and only allow cookies in individual cases, exclude cookies in certain cases or in general, and activate the automatic deletion of cookies when you close your browser. If cookies are deactivated, the functionality of this website may be restricted.

If cookies from third-party companies are used or cookies are used for purposes of analysis, we will inform you about this separately in accordance with this Data Privacy Statement and ask for your consent if necessary.

The Wacon Cookie Consent Box is used to obtain the legally prescribed consents for the use of cookies. The legal basis for this is Art. 6(1)(1)(c) GDPR.

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data will not be merged with other data sources.

These data are collected on the basis of Article 6(1)(f) GDPR. The website operator has a legitimate interest in ensuring that its website is optimised and displayed without any technical errors – this requires the server log files to be recorded.

Contact form

If you send us enquiries using our contact form, your information from the enquiry form, including the contact details which you enter there, is retained by us for the purpose of processing the enquiry and in case of follow-up questions. We will not forward these data without your consent.

These data are processed on the basis of Article 6(1)(b) GDPR, provided that your enquiry is related to the fulfilment of a contract or is necessary to carry out pre-contractual activities. In all other cases, the processing is based on our legitimate interests in the effective processing of the requests we receive (Art. 6(1)(f) GDPR) or on your consent (Art 6(1)(a) GDPR) if this was requested. Your consent can be revoked at any time.

The data you enter into the contact form shall be retained by us until you ask for it to be erased, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory legal provisions, in particular storage periods, remain unaffected.

E-mail, telephone or fax enquiries

If you contact us by e-mail, telephone or fax, your enquiry including all the personal data resulting from it (name, enquiry) will be stored and processed by us for the purpose of processing your query.

6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this was requested. All our staff have been and are being trained on the topic of data protection and instructed in safe and confidential handling of data. 4. Analysis tools and advertising

Google Tag Manager

We use Google Tag Manager. The provider of this service is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. Google Tag Manager itself does not create any user profiles, store any cookies or carry out any independent analyses. Its sole purpose is to manage and run the tools that have been integrated via it. However, Google Tag Manager does record your IP address, which may also be transferred to Google’s parent company in the United States.

Google Tag Manager is used on the basis of Article 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and administration of various tools on its website. If corresponding consent has been requested, data is processed exclusively on the basis of Article 6(1)(a) GDPR and Section 25(1) TTDSG (German Act on the Regulation of Data Protection and Privacy in Telecommunications and Telemedia), provided that the consent includes the storage of cookies or access to information on the user’s end device (e.g. device fingerprinting) within the meaning of the TTDSG. This consent can be withdrawn at any time.

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. The website operator receives a variety of usage data, including the pages accessed, time spent on the pages, the operating system used and the user’s origin. This data is amalgamated in a user ID and assigned to the respective end device of the website visitor.

Google Analytics uses technologies that enable the user to be recognised for the purpose of analysing the user’s behaviour (e.g. cookies or device fingerprinting). The information collected by Google about use of this website will generally be transmitted to a Google server in the USA and stored there.

The use of this service is based on your consent (Art. 6(1)(a) GDPR and Section 25(1) TTDSG). This consent can be withdrawn at any time.

The transfer of data to the USA is based on the Standard Contractual Clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymisation

We have enabled the IP anonymisation function on this website. This means that within member states of the European Union or in other signatory states to the Agreement on the European Economic Area, your IP address will be abbreviated by Google before transmission to the USA. Only in exceptional circumstances will your full IP address be transmitted to a Google server in the USA and abbreviated there. On behalf of the operators of this website, Google will use this information to evaluate your use of the website, compile reports on website activities, and provide other services connected with website usage and Internet usage to the website operators. The IP address transmitted by your browser in the context of Google Analytics will not be combined with any other data held by Google.

Demographics and interests data in Google Analytics

This website uses Google Analytics’ demographic features, in order to be able to show suitable advertising from within the Google advertising network to site visitors. These data are taken from interest-based advertising from Google as well as from visitor data from third-party providers. These data cannot be attributed to a particular person. You can deactivate this function at any time in the display settings of your Google account, or refuse the acquisition of your data by Google Analytics in general as described in “Objection to data acquisition”.

Google Ads Remarketing

This website uses the functions of Google Ads Remarketing. The provider of these solutions is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.
With Google Ads Remarketing, we can assign people who interact with our online offering to specific target groups in order to subsequently display interest-based advertising to them in the Google advertising network (remarketing or retargeting).
Moreover, it is possible to link the advertising target groups generated with Google Ads Remarketing to device encompassing functions of Google. This makes it possible to display interest-based customized advertising messages, depending on your prior usage and browsing patterns on a device (e.g., cell phone) in a manner tailored to you as well as on any of your devices (e.g., tablet or PC).
If you have a Google account, you have the option to object to personalized advertising under the following link:
https://www.google.com/settings/ads/onweb/.
The use of these services occurs on the basis of your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TTDSG. You may revoke your consent at any time. For further information and the pertinent data protection regulations, please consult the Data Privacy Policies of Google at:
https://policies.google.com/technologies/ads?hl=en.

Formation of Target Groups with Customer Reconciliation

For the formation of target groups, we use, among other things, the Google Ads Remarketing customer reconciliation feature. To achieve this, we transfer certain customer data (e.g., email addresses) from our customer lists to Google. If the respective customers are Google users and are logged into their Google accounts, matching advertising messages within the Google network (e.g., YouTube, Gmail or in a search engine) are displayed for them to view.

Google Conversion-Tracking

This website uses Google Conversion Tracking. The provider of this service is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. With the assistance of Google Conversion Tracking, we are in a position to recognize whether the user has completed certain actions. We do not receive any information that would allow us to personally identify the users. Google as such uses cookies or comparable recognition technologies for identification purposes.

Google DoubleClick

This website uses Google DoubleClick functions. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter referred to as “DoubleClick ”).

DoubleClick is used in order to show you interest-related advertising from the entire Google advertising network. The advertisements can be targeted to the interests of the viewer in question by the use of DoubleClick. This means that our advertisements can for example be shown in Google search results or in advertising banners linked to DoubleClick.

In order to be able to show users advertising appropriate to their interests, DoubleClick needs to be able to recognise the individual viewer and allocate websites visited, clicks and other information to the user behaviour. For this purpose, DoubleClick uses cookies or comparable recognition technologies (e. g. device fingerprinting). The information collected is summarised as a pseudonymous user profile in order to show the relevant user interest-related advertising.

The use of this service is based on your consent (Art. 6(1)(a) GDPR and Section 25(1) TTDSG). This consent can be withdrawn at any time.

Facebook pixel

To measure conversion rates, this website uses Facebook’s visitor action pixel. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, however, the collected data will also be transferred to the USA and other third countries.

After clicking on a Facebook ad and being redirected to the provider’s website, this tool enables the behaviour of website visitors to be tracked. This makes it possible to analyse the effectiveness of Facebook ads for statistical and market research purposes and to optimise future advertising campaigns.

For us as the operator of this website, the collected data is anonymous and we are unable to arrive at any conclusions as to the identity of users. However, the data is stored and processed by Facebook, so that it can be linked to the respective user profile and Facebook is able to use the data for its own promotional purposes in accordance with Facebook data use guideline . This enables Facebook to display ads on Facebook pages as well as in locations outside of Facebook. As the operator of this website, we have no control over the use of such data.

The use of this service is based on your consent (Art. 6(1)(a) GDPR and Section 25(1) TTDSG). This consent can be withdrawn at any time.

If you assert your data subject rights with us, we are obliged to forward them to Facebook.

Further information about the protection of your privacy can be found in Facebook’s Data Privacy Policy: https://de-de.facebook.com/about/privacy/.

In particular, we record the time of the call-up, the website called up, your IP address and your user agent and if required further specific information (e. g. products bought, value of the shopping cart and currency). Commissioned data processing

This is a contract prescribed by data protection law, which ensures that the service provider processes the personal data of our website visitors solely in accordance with our instructions and in compliance with the GDPR.

5. Plugins and tools

YouTube with enhanced privacy

Our website contains links to YouTube videos. YouTube is operated by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in the enhanced data protection mode. According to YouTube, this mode prevents YouTube from retaining information on the visitors to this website before they view the relevant video. On the other hand, the enhanced data protection mode does not necessarily prevent YouTube from forwarding data to YouTube partners. For example, YouTube will establish a connection to the Google DoubleClick network irrespective of whether or not you view a video.

As soon as you start a YouTube video on this website, a connection is established to YouTube servers. This informs YouTube servers which of our pages you have visited. If you are logged into your YouTube account, you are enabling YouTube to link your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, YouTube may store various cookies on your end device after playing a video or use comparable recognition technologies (e.g. device fingerprinting). This enables YouTube to obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience and prevent fraud attempts.

Potentially, further data processing procedures may be triggered after playing a YouTube video, over which we have no control.

The use of YouTube is in the interest of displaying our online content in an appealing way. This represents a legitimate interest within the meaning of Article 6(1)(f) GDPR. OpenStreetMap

We use the map service of OpenStreetMap (OSM).

We integrate the map material from OpenStreetMap on the server of the OpenStreetMap Foundation, St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom. The UK is considered a secure third country as far as data privacy legislation is concerned. This means that the UK has a level of data protection that corresponds to data protection standards in the European Union. When you use maps from OpenStreetMap, a link to the OpenStreetMap Foundation servers is created. When you do this, your IP address and further information on your behaviour on this website may be passed on to the OSMF. OpenStreetMap may store cookies in your browser for this purpose or use comparable recognition technology.

We use OpenStreetMap in order to provide an attractive look to our online presence and to make it easy to find places we mention on the website. This represents a legitimate interest within the meaning of Article 6(1)(f) GDPR.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter “reCAPTCHA”) on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is used to check whether data entry on this website (e.g. on a contact form) is made by a human being or by an automated program. For this purpose, reCAPTCHA analyses the behaviour of the visitor to the website by means of various observations. This analysis is started automatically as soon as the website visitor visits the website. For the analysis, reCAPTCHA evaluates various pieces of information (e.g. IP address, length of stay of the website visitor on the website or the mouse movements made by the user). The data collected during the analysis is passed to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not advised that an analysis is taking place.

The storage and analysis of data takes place on the basis of art. 6 (1) (f) GDPR. Website operators have a legitimate interest in protecting their web services from abusive, automated spying and from SPAM. If corresponding consent has been requested, data is processed exclusively on the basis of Article 6(1)(a) GDPR and Section 25(1) TTDSG (German Act on the Regulation of Data Protection and Privacy in Telecommunications and Mediate), provided that the consent includes the storage of cookies or access to information on the user’s end device (e.g. device fingerprinting) within the meaning of the TTDSG. This consent can be withdrawn at any time.
